Privacy Policy

At Spark Tech Labs Inc., we take your privacy seriously.

This privacy policy ("Policy") explains what kind of information Spark Tech Labs Inc., and its subsidiaries and affiliates (collectively, “Spark Tech”), collects and stores, including Personal Information (as defined herein) in connection with the operation of our CloudHawk solution.

Our goal is to:

  1. Be transparent about the different types of information we collect and how we use them.
  2. Ask your permission before sharing your Personal Information with third parties for purposes other than to provide Spark Tech services, and to do so only when we think they will provide you with a welcome additional service.
  3. Use industry standard data security tools to keep your data safe and protect the CloudHawk solution from unauthorized access.

By using this service, you agree to allow us to collect and process personal information as described below.

As used in this Policy, "Personal Information" means information that is about an identifiable individual, including but not limited to, names, street addresses, e-mail addresses, and phone numbers.  Personal information does not include "aggregate" information, which is data we collect about or through the use of the Site or through the Services from which individual identities or other personal information has been removed. This Policy in no way restricts or limits our collection and use of aggregate information. 

What information does CloudHawk solution collect?

  • Information input during setup and activation
  • Location data from CloudHawk tracker sensors
  • Technical information from the device

Information input during setup:

When you register a new account or add a CloudHawk tracker you will be asked to provide personal information including your name, contract information and email address, as well as billing information. From that point forward, your email address is used for communications about the CloudHawk service. CloudHawk will use your billing information to process payments for your subscription. If you order trackers or other devices or accessories from CloudHawk, you will be asked to provide a delivery address for shipping purposes.

Location data from CloudHawk tracker sensors:

During the time that you use CloudHawk trackers the device collects non-personal information such as latitude, longitude, velocity, temperature, altitude, direction and signal strength for both GSM and GPS networks. This information as well as reports derived from this information is made available to the account owner for devices associated with an account. CloudHawk aggregates and anonymizes this information and uses it to improve the Site and Service, to enhance your experiences when visiting our Site or using the Service.

Technical information from the device:

In order to improve your experience over time and help troubleshoot any problem you may encounter with CloudHawk, we record your model, serial number, SIM card number, software version, and technical information such as battery charge level.

Additionally, like most Internet sites, we routinely record log entries (including information such as your IP address) and technical information (such as your browser type and version) when your browser, mobile device contacts our servers. These log files are used for troubleshooting and are stored on our cloud servers.

Information Sharing

Over time, Spark Tech may provide the opportunity for you to interface CloudHawk Products to one or more third party products and services, which will involve the exchange of information from your CloudHawk Product. Your explicit consent and authorization will be required for this interface, and will be revocable by you at any time. We will not share the personal information we collect from you with third parties except as otherwise described in this Policy.

We may share your personal information with Service Providers who are engaged by or working with us in connection with the operation of the Site or the provision of the Services and who need access to such information to carry out their work for us. For example, in some cases, the Service Provider may be directly collecting the information from you on our behalf. We may use third party service providers to verify financial information, such as the validity of a credit card. We may also share personal information with other third parties, including, but not limited to customer service agencies for research and analysis purposes so that we can monitor and improve the services we provide, and to our partners.  We may also disclose Information to other carefully selected third parties whose products or services we believe may be of interest to you. . We are not responsible for the actions of Service Providers or other third parties, nor are we responsible for any additional information you provide directly to these Service Providers or other third parties, and we encourage you to become familiar with their practices before disclosing information directly to them. We may share aggregate information and other information that does not identify you with third parties without your consent.

We may disclose personal information in the good faith belief that we are lawfully authorized or required to do so, or that doing so is reasonably necessary or appropriate to comply with the law or with legal process or authorities, respond to any claims, or to protect the rights, property or safety of CloudHawk, our users, our employees or the public, including without limitation to protect CloudHawk or our users from fraudulent, abusive, inappropriate or unlawful use of our Site. Information about our users, including personal information, may also be disclosed or transferred as part of, or during negotiations of, any merger, sale of company assets, financing or acquisition or in any other situation where personal information may be transferred as one of the business assets of CloudHawk.

Location of Data Storage and Processing

CloudHawk and its service providers store data, including Personal Information, on servers located in Canada and United States. By submitting information, you agree to this transfer, storing or processing of your Personal Information in Canada and U.S. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in Canada and the United States under lawful access regimes or court order.

Updating, Correcting or Deleting Your Personal Information

If you have an online account with us, you may change any of your personal information in your account online at any time via "Settings." You may ask to have the information on your account deleted or removed. You may also contact us at the email or address listed below and request that we update, correct or delete any personal information we have collected, and we will endeavor to respond to your inquiry or to correct, update or remove the personal information you have provided us as you indicate. However, please note that in some cases, we may believe it is necessary or appropriate to retain certain personal information we have collected, and the deletion of such personal information will be in our discretion unless otherwise required by law.

As an additional security measure we may "back up" the data stored on our systems. Data archived for back-up purposes at a given point in time may include information that you corrected or deleted after the back-up was made.

Online Information Security

We have endeavored to put into place and maintain reasonable industry-recognized security measures in an effort to protect the security of your personal information. For example, if you have an online account, it is only accessible through the use of a password. To protect the confidentiality of your information, to the extent you obtain a password for access to the Site or for use in connection with the Services, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Site and Services by any person using your password. Please advise us immediately if you believe your password has been misused or misappropriated.

Email Subscriptions and Notifications

CloudHawk may use your contact information to send you additional marketing or promotional communications from us. You may "opt-out" of receiving these marketing or promotional communications from us by emailing at privacy@cloudhawk.com or simply by choosing to opt-out from any of the communications themselves. You can withdraw your consent at any time.

Changes to this Policy

We reserve the right to change the provisions of this Policy at any time. We will update you that material changes to this Policy have been made by announcing the updates on our Site. If we make any change to our Policy, previously collected information will continue to be governed by the protections of the Policy in effect at the time the information was collected.

Changes in Ownership

Spark Tech may decide to sell, buy, merge, or reorganize businesses to further strategic or business interests. Where a transaction of this kind involves disclosing personal information to prospective or actual purchasers, our practice is to seek appropriate protections consistent with our Policy.
